Job Seeker Platform Terms and Conditions

1. DEFINITIONS AND INTERPRETATION
1.1 "Company" refers to Prime Job Search, a digital employment facilitation platform operated under the laws of India.
1.2 "User" or "Job Seeker" refers to any individual registering, accessing, or using the Platform.
1.3 "Platform" means the digital portal, website, or mobile application operated by Prime Job Search.
1.4 Unless repugnant to the context, singular includes plural and vice versa. Headings are for convenience only and do not affect interpretation.
2. NATURE AND SCOPE OF PLATFORM
2.1 The Platform functions solely as an online medium enabling interaction between Job Seekers and Employers.
2.2 The Company does not act as an employer, recruiter, agent, representative, or guarantor of employment.
2.3 All postings, communications, and engagements are created and managed by third-party employers or recruiters.
2.4 The Company expressly disclaims all responsibility for the accuracy, authenticity, or completeness of such information.
3. NO GUARANTEE OF EMPLOYMENT
3.1 Registration or use of the Platform does not create any obligation upon the Company to procure, guarantee, or facilitate employment.
3.2 The Company makes no representation or warranty regarding the availability, suitability, or authenticity of any job listing, employer, or opportunity.
3.3 The Job Seeker acknowledges that all employment-related decisions rest exclusively between the Job Seeker and the Employer.
4. PAID SERVICES AND REFUND POLICY
4.1 Certain enhanced features or promotional services may be offered for a fee.
4.2 Payments made to the Company are strictly for access to digital services and shall not be construed as consideration for employment placement or recruitment.
4.3 All fees are non-refundable, non-transferable, and non-adjustable, save as required under applicable law.
4.4 Payment does not create any assurance or commitment of job acquisition or employment outcome.
5. LIMITATION OF LIABILITY
5.1 The Company, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damage, including but not limited to loss of income, opportunity, or goodwill.
5.2 The Company shall not be responsible for:
- (a) false or misleading information posted by third parties;
- (b) any fraudulent or negligent act of an employer or recruiter;
- (c) system failures, service interruptions, or technical errors.
5.3 In any event, the maximum aggregate liability of the Company shall not exceed the total amount paid by the User for the specific service within the preceding three (3) months.
6. INDEMNIFICATION
6.1 The User agrees to indemnify and hold harmless the Company and its affiliates from any and all claims, damages, costs, liabilities, and expenses (including legal fees) arising out of:
- (a) the User's breach of this Agreement;
- (b) inaccuracy or misrepresentation of information provided by the User; or
- (c) disputes between the User and any Employer or third party.
7. NO EMPLOYMENT OR AGENCY RELATIONSHIP
7.1 Nothing contained herein shall be construed to create any relationship of employment, agency, partnership, or joint venture between the Company and the User.
7.2 The Platform is merely a digital intermediary and does not participate in or influence hiring decisions.
8. USER OBLIGATIONS AND DUE DILIGENCE
8.1 The User shall furnish accurate and truthful information during registration and use.
8.2 The User shall independently verify the authenticity of employers, job listings, and communications.
8.3 The Company shall bear no responsibility for any disclosure of personal or financial data by the User to third parties.
9. ELECTRONIC CONSENT AND RECORD
9.1 In accordance with the Information Technology Act, 2000, electronic acceptance of these terms shall constitute a valid and binding agreement.
9.2 The Company shall be entitled to store electronic consent records as proof of acceptance by the User.
10. GOVERNING LAW AND JURISDICTION
10.1 This Agreement shall be governed by and construed in accordance with the laws of India.
10.2 All disputes, claims, or proceedings arising hereunder shall be subject to the exclusive jurisdiction of the competent courts at Sasaram, District Rohtas, Bihar – 821115, to the absolute exclusion of any other court or tribunal.
11. FORCE MAJEURE
11.1 The Company shall not be liable for any failure or delay in performance arising from circumstances beyond its reasonable control, including but not limited to natural calamities, network failures, system breakdowns, governmental restrictions, or force majeure events.
12. SEVERABILITY AND AMENDMENT
12.1 If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.2 The Company reserves the right to amend, revise, or update this Agreement at any time without prior notice, and continued use of the Platform shall constitute acceptance of such changes.
13. ENTIRE AGREEMENT AND NON-RELIANCE
13.1 This Agreement constitutes the entire understanding between the User and the Company, superseding all prior communications or representations.
13.2 No oral statements, advertisements, or representations shall modify the terms herein unless expressly approved in writing by the Company.
